Guest belongings: match custody procedures to the law

Treat a Texas guest-property complaint as a custody investigation, not simply a missing-item report. Identify whether the item disappeared from a room, a checked baggage area, a delivery shelf or a vehicle. Ask counsel to review the current innkeeper rules before relying on a liability limitation. This page does not state a statutory section, cap or notice location for this state; confirm the current provisions with counsel before relying on a sign or disclaimer.

For a highway motel, an overnight traveler may leave tools in a truck; an airport hotel may accept luggage hours before check-in. Those are different loss scenarios. As a practical control, use numbered baggage receipts, record who accepted each package and restrict storage access. Have counsel approve any safe notice, including its wording and placement, before using it as a legal defense. A generic disclaimer copied from another property is not a substitute for that review.

Ask for innkeepers legal liability or guest-property coverage that fits the belongings actually entrusted to staff. General liability can restrict coverage for property in your care, custody or control. A hotel building policy does not automatically insure a traveler’s possessions, and vehicle damage may call for garagekeepers coverage. These requirements change; confirm them with counsel or a licensed agent.

Alcohol permits and the service footprint

The Texas Alcoholic Beverage Commission is the state reference point for alcohol licensing. Before adding a lobby bar, catered reception or complimentary evening service, ask which authorization fits the premises and who must hold it. Do not assume that giving a drink away makes the service irrelevant to licensing or insurance. Current dram shop standards should be checked with counsel rather than inferred from the type of hotel.

Describe alcohol sales, service hours and outside caterers to the agent. Compare liquor liability with any host-liquor provision, and review assault exclusions and umbrella treatment. For a restaurant leased to another operator, obtain the lease, insurance evidence and responsibility allocation rather than assuming the tenant’s policy protects every hotel entity.

Pool and spa operations in Texas

An outdoor pool can create a long operating season and a maintenance workload that changes with occupancy. Confirm the applicable public-pool code, inspection authority and spa requirements for the property address before opening or renovating. Ask the reviewing authority about barriers, drains, warning signs and operating records; this page does not prescribe unverified dimensions or inspection intervals.

Assign responsibility for water testing, closing unsafe areas and documenting repairs across shifts. Submit the pool, hot tub and any water features to the liability underwriter, including whether outside visitors can use them. Equipment-breakdown coverage and business-income coverage address different financial consequences from an injured guest’s liability claim.

Occupancy tax and local collections

The Texas Comptroller states that the state hotel occupancy tax rate is 6 percent of the room cost. It also identifies additional local hotel taxes authorized for cities, certain counties and special purpose districts, collected by the local taxing authority. Reconcile the state calculation separately from local accounts rather than treating the reservation system’s single tax field as a complete filing solution.

Keep exemption documentation, booking-channel statements and refund adjustments with the supporting folios. Confirm which party collects and remits each charge when an intermediary is involved. Collected tax should be distinguished from room revenue when reviewing financial records for business-income insurance; tax compliance itself is not replaced by purchasing hotel coverage.

What else do Texas buyers ask about hotel & lodging?

Does a Texas hotel policy insure luggage automatically?

Not necessarily. Request guest-property wording and examine custody exclusions and applicable sublimits.

Should local hotel taxes be tracked separately?

Yes. The Comptroller distinguishes the state tax from locally collected hotel taxes; verify the property’s local accounts.

Can a leased restaurant leave the hotel exposed?

A claim can name multiple parties. Review contractual duties and both operators’ insurance with an agent.
